Is surrogacy legal in Colombia?

Colombia does not currently have a single comprehensive law regulating gestational surrogacy. Instead, the practice is supported through constitutional principles, court decisions, and legal interpretation. Each journey should follow the applicable legal procedures in force at the time of treatment.

Parentage and travel documents are handled through defined legal processes and are not automatic. Medical care

Pregnancy monitoring may include ultrasounds, standard screening tests, genetic testing, and regular assessments to support the health of the surrogate and the pregnancy. Tammuz coordinates this care, while medical decisions and outcomes depend on the medical team and each individual pregnancy.

Surrogates

The surrogates in the Colombia program are carefully screened women based in Bogotá who have previously had at least one healthy pregnancy and birth. Screening may include medical and psychological assessment, background checks, lifestyle declarations, and a social-worker home visit. Throughout the pregnancy, surrogates continue living at home with their families and receive ongoing medical monitoring and support.

Egg donation

Egg donors in the Colombia program complete comprehensive medical and psychological screening before joining, which may include genetic, hormonal, infectious-disease, reproductive, and psychological assessments. Intended parents receive donor information to support their decision. If you need to create embryos, your pathway may include medical testing, sperm collection, egg-donor selection, IVF, embryo development, genetic testing when applicable, and embryo cryopreservation. If you already have embryos, their medical records and suitability for shipment and transfer must first be reviewed. During pregnancy, your surrogate receives prenatal care that may include appointments, ultrasounds, laboratory tests, specialist assessments, and other examinations recommended by the treating medical team. Medical decisions are made by the independent professionals responsible for treatment and care.

Surrogates
Before you are introduced to a potential surrogate, she goes through a structured assessment process conducted by the professionals responsible for recruitment and screening. This may include medical and psychological assessments, a review of her pregnancy history, background and lifestyle information, and other relevant checks. Surrogate candidates must have experienced at least one healthy pregnancy and birth. Once you are presented with a potential match, you receive the available information and can learn more about her before moving forward. During pregnancy, she continues living her daily life and receives medical monitoring and program support.

Egg Donors
If you need an egg donor, you will receive donor information according to the program policies and applicable regulations. Screening may include medical, psychological, genetic, hormonal, reproductive, and infectious-disease assessments. Genetic compatibility testing may also be required. The details available to you, including whether donor images or identifying information can be shared, depend on the applicable program and regulations.

Legal Process
Your legal journey includes more than one document. Depending on your case, it may involve the agreement with your surrogate, birth registration, your baby’s local documentation, DNA testing where required, passport and travel documents, immigration or exit requirements, and further parentage-related proceedings. Birth, citizenship, parentage, and permission to travel are separate legal questions, and some procedures may continue after you return home.

If you are living with HIV, Colombia may provide a possible pathway to parenthood through surrogacy, subject to individual medical eligibility.
